By logging into Naviance, you agree to these binding Terms of Use, which are in place to ensure that Naviance is able to fulfill its promise to you and the students we collectively serve.

Uploading Information:

You will not:

1. upload, post, e-mail, or otherwise transmit any material that is unlawful, harmful, threatening, intimidating, abusive, harassing, tortious, defamatory, derogatory, vulgar, obscene, libelous, invasive of another’s privacy, disrespectful, hateful, or racially, ethnically, or otherwise objectionable, or that discusses or incites illegal activity;
2. forge headers or otherwise manipulate identifiers in order to disguise the origin of any material transmitted through Naviance;
3. infringe on others’ rights, or post content that does not belong to you unless you have permission from the owner;
4. interfere with or disrupt Naviance, its servers, or networks connected to Naviance, or disobey any requirements, procedures, policies, or regulations of networks connected to Naviance;
5. violate any applicable local, state, national, or international law or regulation; or
6. upload, post, e-mail, or otherwise transmit any material that contains software viruses, worms, Trojan horses, malicious code, or any other computer code, files, or programs designed to disable, interrupt, destroy, redirect, monitor another user’s usage, or limit or otherwise inhibit the functionality of any computer software or hardware or telecommunications equipment. If we discover that such material is infected, we may reject that material with no notice to you.

Your Account:

1. You represent that you are an authorized Customer or User of Naviance.
2. You will not:
   1. decompile, disassemble, or reverse engineer Naviance, except to the extent expressly authorized under applicable law;
   2. use Naviance or any of the confidential information therein to develop a competing product or service;
   3. impersonate another Naviance user or provide false information to gain access to Naviance;
   4. view or attempt to view information or records that you are not authorized to view by your school or district;
   5. allow anyone who is not an authorized Customer or User of Naviance to view, access, or use Naviance; or
   6. create accounts for, or share accounts with, any individual or entity that is not an authorized Customer or User of Naviance.
3. You shall: (i) maintain the confidentiality of your account name and password; (ii) notify Naviance, Inc. immediately of any unauthorized use of any password or account or any other known or suspected breach of security; and (iii) report to Naviance, Inc. immediately, and stop immediately, any known or suspected use of Naviance that is inconsistent with these Terms of Use.

By logging into Naviance, you represent that you have read and agree to these Terms of Use. You understand that Naviance has the right to block, modify, or remove any users or material that, in its sole discretion, violate(s) these Terms of Use. If you are not already a Customer or User, by logging into Naviance you agree, on behalf of yourself, your employer, and any other entity on whose behalf you are acting, to be legally bound by these Terms of Use and by the Naviance Terms of Service, which are available here and incorporated herein by reference. Capitalized terms used but not defined in these Terms of Use, including “Customer” and “User,” have the meanings set forth in the Terms of Service.
